1. Disclaimer of Guarantees and Client Responsibility
The services and AI solutions provided by Beyond Agents AI are offered “as is” for informational, operational, and business process support purposes only. We do not make any guarantees regarding performance, results, lead conversion, or business outcomes.
The success of any AI implementation depends on multiple variables outside of our control, including your internal processes, data quality, marketing channels, and compliance obligations. You acknowledge that any business decisions made based on our services are made at your own discretion and risk.
Beyond Agents AI shall not be held responsible or liable for any business loss, regulatory action, or reputational damage resulting from the use or misuse of our services. Clients are solely responsible for ensuring compliance with industry laws, including but not limited to telemarketing laws, data protection regulations, and advertising standards.
2. Cookie Policy
We use cookies and similar tracking technologies to improve your experience on our website. By using our site, you consent to our use of cookies in accordance with your browser settings. Disabling cookies may affect certain site functionalities.
3. Refund Policy
All payments made to Beyond Agents AI are non-refundable unless otherwise specified in a written service agreement. Requests for refunds due to service errors must be submitted to [email protected] within 30 days of the issue. Refunds are reviewed case-by-case basis and granted at our sole discretion.
4. Acceptable Use Policy (AUP)
You agree to use Beyond Agents AI services in a lawful, ethical, and respectful manner. You may not use our services to:

Engage in spamming, phishing, fraud, or deceptive marketing
Transmit malicious code, malware, or unauthorized scripts
Harass, defame, or abuse others

We reserve the right to suspend or terminate service without notice for violations of this policy.
5. Service-Level Commitment
We aim to provide 99.9% uptime for hosted services, excluding scheduled maintenance or unavoidable disruptions. In the event of downtime, we will work to restore services promptly. For critical support issues, you may expect a response within 3 business hours.
6. Limitation of Liability
To the maximum extent permitted by law, Beyond Agents AI disclaims all liability for any indirect, incidental, consequential, or special damages, including lost revenue, profit, data, or business opportunities, even if we were advised of the possibility of such damages.
Our total liability for any claim or dispute shall not exceed the amount paid by you to Beyond Agents AI in the 12 months preceding the incident giving rise to the claim.
7. No Legal, Compliance, or Marketing Guarantees
Beyond Agents AI is not a legal advisor, compliance consultant, or licensed marketing agency. We do not guarantee that the use of our services, including AI voice agents, outbound dialers, or marketing workflows, complies with all federal, state, or local regulations.
It is the sole responsibility of the client to consult legal counsel and ensure compliance with all applicable laws, including but not limited to the TCPA, GDPR, CAN-SPAM, and CCPA.
8. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, USA. Any legal dispute must be brought in the courts of Delaware, and you consent to the jurisdiction of those courts.
9. Dispute Resolution & Arbitration
If any dispute arises, we encourage you to contact us first at [email protected] to attempt an informal resolution. If a resolution cannot be reached, you agree to resolve the dispute exclusively through binding arbitration in Delaware, and waive any right to a trial by jury or participation in a class-action lawsuit.
10. Modifications to Terms
We may revise these terms at any time. Updates will be posted on this page with a revised effective date. Continued use of our services after changes constitutes your acceptance of the new terms.
